Nan Eitel is a partner in the firm’s Business & Commercial Litigation Practice Group, where she focuses on complex commercial litigation. Ms. Eitel’s areas of concentration include the defense of national and state class actions, bankruptcy and creditor rights, commercial fraud and recovery, redhibition and products liability, contractual disputes, unfair trade practices, and directors' and officers' insurance issues. She also has extensive experience in a variety of federal and personal jurisdiction matters.
Ms. Eitel, a native of Baton Rouge, Louisiana, joined Jones Walker’s New Orleans office in 1989 upon her graduation from University of Virginia School of Law.
Representative Matters
- Defense of numerous national and state class action suits, with particular emphasis on procedural and jurisdictional issues, including certification and removal
- Defense of automobile manufacturers in class action suits for redhibition, misrepresentation, and breach of implied or express warranties
- Defense of parens patriae antitrust suits brought by State Attorney General
- Bankruptcy litigation concerning, among others:
-confirmation of Chapter 11 and Chapter 13 plans
-contesting dischargeability of a debt
-contesting debtor’s right to discharge
-contesting debtor’s right to claim exempt property
-seeking secured creditor’s right to set-off
-cash collateral orders
-defense of equitable subordination claims
-adequate assurance for utilities
-defense of preference actions against creditors
-moving to modify stay
-seeking appointment of trustee in Chapter 11 case
-defending claims for violation of the automatic stay - Commercial collection suits, including enforcement of promissory notes and franchise agreements
- Litigation concerning priority of competing liens and seizures
- Post-judgment remedies, including seizures and garnishments
- Pre-judgment remedies, including federal and state court writs of attachment and sequestration
- Directors and Officers insurance coverage litigation and counseling
